Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of the table extraction web application ("Service") provided by Tablextract ("Company," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

2. Subscription and Payments

2.1 Subscription Tiers

The Service offers three subscription tiers: Monthly, Yearly, and Lifetime, each with different features and extraction limits as described on our pricing page. We also offer additional extraction credits that can be purchased separately.

2.2 No Free Tier

We do not offer a free tier or free trial for our Service. All access to the Service requires an active paid subscription.

2.3 Payment Terms

All payments for subscriptions must be made in advance. By subscribing to the Service, you authorize us to charge the applicable subscription fee to your payment method on file. We use Stripe, a third-party payment processor, to process payments. Your use of the Service is also subject to Stripe's terms of service.

2.4 Subscription Renewal

Monthly and Yearly subscriptions will automatically renew at the end of the applicable subscription period unless canceled at least 24 hours before the end of the current subscription period.

2.5 No Refunds

All purchases are final. We do not provide refunds for any subscriptions or extraction credits, regardless of usage. This no-refund policy applies to all subscription tiers, including Monthly, Yearly, and Lifetime plans.

2.6 Lifetime Subscription

A "Lifetime" subscription grants you access to the Service for as long as the Service continues to exist and operate. It does not refer to your personal lifetime. If the Service is discontinued or the Company ceases operations, your Lifetime subscription will terminate without any partial or complete refund.

2.7 Price and Feature Changes

We reserve the right to change our subscription plans, pricing, and features at any time, including during an active subscription period. Continued use of the Service after such changes constitutes acceptance of the new terms.

3. Acceptable Use

3.1 Compliance with Laws

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

  • In any way that violates any applicable federal, state, local, or international law or regulation
  • To engage in any activity that infringes on anyone's copyright, trademark, or other intellectual property rights
  • To transmit any material that is defamatory, obscene, invasive of another's privacy, harassing, or otherwise objectionable

3.2 Usage Limitations

You shall not:

  • Automate the use of our Service for table extraction, scraping, or any similar purpose
  • Use the Service to extract data in a manner that violates the terms of service of the source of the data
  • Attempt to bypass any usage limits or quotas imposed by your subscription tier
  • Share your account credentials with others or allow multiple users to use a single account
  • Resell or redistribute the outputs of the Service without our express written permission
  • Reverse engineer, decompile, or attempt to discover the source code of the Service
  • Use the Service to create a competitive product or service

3.3 Anti-Abuse Provisions

We reserve the right to monitor usage patterns and implement anti-abuse mechanisms. We may limit, suspend, or terminate your access if we detect patterns indicating abuse, excessive use beyond reasonable limits, or automated access.

3.4 Content Responsibility Disclaimer

We are not responsible for the information or data that you extract using our Service. You are solely responsible for ensuring that you have the legal right to upload, process, and extract data from any documents or images you submit to our Service. We cannot be held liable if you upload documents or data that you were not legally permitted to access, possess, process, share or store.

4. Account Security

4.1 Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4.2 Account Information

You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

5. Intellectual Property

5.1 Service Ownership

The Service, including all content, features, and functionality, is owned by the Company and is protected by copyright.

5.2 User Content

You retain ownership of any content you upload to the Service. By uploading content to the Service, you grant us a non-exclusive, royalty-free license to use, store, and process the content solely for the purpose of providing the Service to you and for research, internal processing, and product enhancement and development purposes.

5.3 Output Ownership

You own the output data generated by the Service based on your inputs. However, we retain the right to analyze usage patterns in an anonymized, aggregated format to improve our Service.

6. Limitation of Liability

6.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

6.2 Limitation of Liability

IN NO EVENT SHALL THE COMPANY, ITS FOUNDERS, DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE
  • ANY CONTENT OBTAINED FROM THE SERVICE
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT
  • THE ACCURACY, COMPLETENESS, OR QUALITY OF DATA EXTRACTED USING THE SERVICE

THE TOTAL LIABILITY OF THE COMPANY, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, SHALL NOT EXCEED THE AMOUNT YOU PAID TO THE COMPANY FOR THE APPLICABLE SERVICE IN THE PAST TWELVE (12) MONTHS.

7. Service Modifications and Termination

7.1 Service Modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice and you will not be entitled to any refund.

7.2 Account Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

7.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. If your account is terminated due to your breach of these Terms, you will not be entitled to any refund.

8. Indemnification

You agree to defend, indemnify, and hold harmless the Company, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

9. Governing Law and Dispute Resolution

9.1 Governing Law

These Terms shall be governed and construed in accordance with the laws of Madagascar, without regard to its conflict of law provisions.

9.2 Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration in accordance with the laws of Madagascar. The arbitration shall be conducted in Antananarivo, Madagascar, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
